Breach of contract

If the contract between either party was verbal, it will be tricky to conclude that one ever existed, and where any breach could have taken place. Secondly, we must prove that the terms of the agreement were breached. For that, we detail exactly what the offending party’ obligation(s) were within the agreement. There then must be proof that those obligations were not performed or not performed satisfactorily.

Lastly, we must prove that a loss was suffered as a direct consequence of the breach of contract. If damages had occurred as a result of the performance, there may be grounds for compensation. However, it is important to be aware of what the Court might consider. Therefore, our role will be to prove that you mitigated the loss where possible, and provide evidence of what position you would be in if the damage had not occurred. Additionally, we will also need to consider any other factors that might have caused any damage.
