Brexit – The New Points Based System

 

In 2008, a then new points-based system was introduced replacing the work permits and entry schemes with a five-tier system phased in till 2010. Today, after 4 years of Brexit negotiations and leaving the European Economic Area, Britain enforces new legislation of how migrants come to live and work in the UK.

Much like how non-EU applicants were considered before leaving the bloc, EU nationals must now follow a similar process.

When applying for visa applications, Non-EU citizens will continue to submit fingerprints and a photo at a visa application centre overseas. But EU, EEA and Swiss citizens can provide a digital photo using an app on smartphones, with no need for fingerprints.
Skilled workers must speak English and be offered paid employment of a salary threshold of £25,600 by an approved employer sponsor. The job that is offered must have a required skill level of an equivalent A-level. In cases where applicants earn less than the already mentioned but no less than £20,480, applicants may be eligible to apply on a ‘trading’ points basis specified by characteristics against your salary.

Highly skilled workers are open to apply for the Global Talent Scheme, for highly skilled scientists and researchers to come to the UK without being offered a job.

Student Visas are eligible for applicants who have been offered their place on a course and can understand English as well as speak, read, and write English language. Applicants must have enough money to support themselves throughout their education and pay their tuition fees. A new graduate immigration route is available however, for students who have completed their degree from Summer 2021 will allow applicants to work, or look for work in the UK for a set period depending on their qualification.

EU, EEA or Swiss citizens living in the UK on or before 31 December 2020 should not apply under the points-based system but, instead apply for themselves and family to the EU Settlement Scheme before 30 June 2021.

EU, EEA or Swiss and other non-visa nationals visiting the UK do not need a visa to enter UK for up to 6 months.
For immigration lawyers, the routes of the new points-based system are structured upon its predecessor with appendixes attached to the old rules. This is until all the rules are fully consolidated, so we may see changes yet to come.

These appendixes are similar to the previous rules for non-EU citizens and typically follow a points requirement, financial assessment and English language ability.
