The UK’s Most Common Personal Injury Claims

The UK’s most common Personal Injury Claims

A Personal Injury Claim allows people to recover aid where they have suffered a preventable accident that was not their fault. There are many types of accidents that happen in the UK where victims have successfully claimed against the negligent party. The compensation is typically awarded based on their loss of earnings now and in the future, and their needs for care and even damage to personal property. Claimants have up to 3 years to make a claim from when they first realised they had suffered an injury.

Most Personal Injury Claims are handled on a No Win No Fee basis, meaning that when victims make a claim, they do not pay any fees to their lawyer unless they win.

Here are the UK’s most common forms of Personal Injury Claims:

Road Traffic Accidents

Accounting for 50% of the UK’s Personal Injury Claims, RTA’s are the most common cases of Personal Injury Claims. Drivers, passengers, pedestrians, cyclists and motorcyclists, could be entitled to compensation if they have been injured in an accident caused on the road. RTA’s typically happen during:

  • Collisions from; rear end; changing lanes; more than two vehicles; junctions and roundabouts and; overtaking
  • Excessive Speeding
  • Failure to indicate
  • Reversing vehicles
  • Hit and run accidents
  • Reckless or drink driving

Injuries from these accidents can be minor such as sprains and whiplash, to more serious injuries like broken bones and even death in high impact collisions.

Accidents at Work

It is employer’s legal duty to protect their employees from harm and hazards in the workplace. Most employers follow a strict health and safety protocol, but accidents evidently still occur. The most common accidents at work are:

  • Slips and trips on uneven or wet floors, or where cables are exposed
  • Injuries caused where insufficient training has been given to employees
  • Injuries caused by manual handling of heavy objects without the correct supportive equipment
  • Injuries caused by dangerous workplace practices and procedures

Other Personal Injury Claims against employers are also known from exposure to dangerous chemicals and substances where employees work in manufacturing. These result in serious health complications in the future.

Accidents in Public

Also known as Public Liability claims, are accidents taken place on public or private property where pavements, flooring or facilities are proven not safe for people to use. It is the responsibility of the local council or private business to maintain standards and regularly review health and safety within their premises. Common accidents in public places occur when:

  • Floors are wet and failure to properly display hazard signs
  • Poor lighting makes navigating harder
  • Floors are uneven
  • There are unexpected obstacles in the way of walkways

A lot of these accidents take place in supermarkets, restaurants, hotels, and leisure facilities.
