Divorce Proceedings

As of April 2022, the divorce process is now a lot simpler. The Divorce, Dissolution and Separation Act (2020) brings an end to separating couples blaming one another for the breakdown of their marriage, helping them to instead focus on the key practical decisions involving children and their finances.

The changes mean that a spouse, or a couple jointly, can now divorce by stating that their marriage has broken down irretrievably, and removes unnecessary finger-pointing at a time when emotions are already running high.

Additionally, it helps those who were previously locked into an unhappy marriage, or victims of domestic abuse, as the other party can no longer challenge the process, and further harm their victims or trap them in the relationship.

To submit your divorce application, we will work with you on making a statement of irretrievable breakdown. This declares your position as a petitioner that you wish your marriage or civil partnership to be dissolved. If you have been married for 1 year, the relationship has permanently broken down and the marriage is legally recognised in the UK, you should receive a conditional order, followed by the final order, declaring your marriage or civil partnership dissolved.

How long does it take to get divorced?

As of April 2022, you will need to wait for a minimum of 20 weeks between submitting your Conditional Order (formally known as the Decree Nisi) and the Final Order (formally known as the Decree Absolute). This is to give both parties time to reflect on their decision to divorce.

What about making child arrangements and splitting our finances?

We will make sure that these are settled before the Final Order is submitted. Especially where finances are concerned, because if this is not done before the marriage is dissolved, your ex-spouse can still claim your assets. To stop this from happening, we will submit a Clean-break Order.

Child arrangements can also be made, making it clear for both parties on their roles and obligations. Of course, where circumstances change in the future, and if needs be, we can submit the order again so that it reflects your new requirements.
